Second opinion from the occupational physician

Sometimes an employee disagrees with the company doctor's advice. For example about absence or about their health in relation to work. In that case, an employee may request a second opinion. That is stated in the Working Conditions Act.

Important to know:

The second opinion is always conducted by a different company doctor who does not work for ZekerArbo. That way the judgment remains truly independent.

When can an employee request a second opinion?

An employee can request a second opinion when it concerns:

  • A personal opinion from the company doctor about absence.

  • The result of an occupational health examination (PAGO or PMO).

  • An opinion from the company doctor about health and work.

Note: only the employee may request a second opinion, not the employer. This always happens in consultation with their own company doctor. The company doctor may only refuse the request if there are very good reasons to do so.

When is it not possible?

Sometimes a disagreement is not about the medical advice, but about agreements between employer and employee. For example:

  • About which tasks someone must perform.

  • About the adjustment of work.

In that case the employee cannot request a second opinion. He can, however, request a expert opinion from the UWV.

Who carries out the second opinion?

At ZekerArbo we have agreed that the second opinion is carried out by an independent party: Aditum Arbo. The employee may choose which company doctor from Aditum he wants.

Costs?

Those are for the employer. The invoice is anonymous so the employee's privacy remains well protected.

What happens after that?

  • The company doctor of the second opinion only reports his or her findings back to the employee.

  • The employer does not get access.

  • If the employee agrees, their own company doctor does share the opinion.

  • After that, the employee's own company doctor decides for himself whether to adopt the second opinion fully, partially, or not at all.
